1. Introduction
a) Website Owner. Essential Mom LLC (“Essential Mom”) is the owner of this website (“EssentialMom.com” or “Website”). Essential Mom can be contacted by mail at P.O. This online privacy policy notice discloses Essential Mom’s information practices for this Website, including what type of personal identifiable information is requested, how the information is used, and with whom the information is shared.
b) Essential Mom respects the privacy of your information. Essential Mom provides this explanation about its online information practices as a show of its commitment to protect your privacy.
c) Website Visits. In general, you (“you” or the “User”) can visit on EssentialMom.com without disclosing any personal information. Essential Mom may analyze the data gathered from Website visits for trends and statistics.
d) Essential Mom does not sell or rent or share or in any other way use personally-identifying information collected during your use of the Website without your permission.
2. Information Collected.
a) At the time you register on the Website, Essential Mom may collect and store your name, address, credit card numbers and other personally-identifying information. Essential Mom needs this information to provide goods and services that you request and to let you know of additional goods and services about which you might be interested. Essential Mom also uses this information to customize your experience using the Website. Essential Mom may request additional information necessary to establish and maintain User’s account.
b) Essential Mom may also ask you for personally-identifying information at other times, such as if you enter into a promotion, post a classified ad, communicate with Essential Mom, or complete a survey. If you opt-in to receive information regarding a promotion, you give Essential Mom your permission to share your name and e-mail address with the third party offering the promotion.
c) In addition, Essential Mom automatically gathers general statistical information about Users, such as IP addresses, browsers, pages viewed, number of visitors, goods and services purchased, etc., but in doing so Essential Mom does not reference you by individual name, e-mail address, home address, or telephone number. Essential Mom uses this data in the aggregate to determine how much Users use parts of the Website so Essential Mom can improve the Website. Essential Mom may provide this statistical information to third parties, but when it does so it does not provide personally-identifying information without your permission.
d) As part of its service, Essential Mom may use cookies to store and sometimes track information about you. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer`s hard drive. Generally, Essential Mom uses cookies to identify Users and enable Essential Mom to access your account information so you do not have to re-enter it; gather statistical information about usage by registered or unregistered users, research visiting patterns, and help target advertisements based on user interests; assist our retail partners track visits and process orders; and track progress and participation in promotions. In some instances, retail partners and advertisers appearing at the Website may use their own cookies. e) Service Quality Monitoring. Some Website transactions may require a User to telephone Essential Mom, or Essential Mom to call the User. Essential Mom will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. User should be aware that it is Essential Mom’s practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.
f) Lost or Stolen Information. If a User’s credit card or, “password” is lost or stolen, the User should promptly notify Essential Mom in order to enable Essential Mom to cancel the lost or stolen information and to update its records with a changed credit card and/or password.
g) Chat Rooms, Forums and Bulletin Boards. If User participates in an EssentialMom.com chat room, discussion forum, or posts messages to an EssentialMom.com bulletin board, User should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside Essential Mom, who have access to that chat room, forum or bulletin board. Some individual Essential Mom chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Also, User’s expressed opinion is his or her own and should not be considered as reflecting the opinion of Essential Mom. If you submit any information to the Website, you agree not to (1) post or transmit anything that is defamatory, abusive, libelous, unlawful, obscene, threatening, harassing, fraudulent, pornographic, or harmful, or that could encourage criminal or unethical behavior, (2) post or transmit pyramid schemes or chain letters, or conduct gambling, (3) post or transmit anything that violates the copyright or intellectual property rights of any person or entity, (4) post or transmit a virus or any other harmful component, or (5) contact other site users through unsolicited e-mail, telephone calls, mailings or any other method of communication.
h) Links to Other Websites. EssentialMom.com may contain links to other websites. Essential Mom is not responsible for the privacy practices or the content of those other websites. Nor does Essential Mom in any way endorse or promote any such other website or any product or service contained or mentioned therein. Furthermore the privacy practices of an advertiser or promotional service appearing at the any such other websites may differ from Essential Mom’s Privacy Policy. Essential Mom encourages you to read those other privacy policies and practices before responding to the offer.
i) Online Advertising. Some companies that help Essential Mom deliver interactive on-line advertising, such as banner ads, may collect and use information about Essential Mom’s Users to help Essential Mom better understand the types of advertising or promotions that are most appealing to Essential Mom’s Users. After it is collected the information is aggregated so it is not identifiable to a specific individual.
3. Information Security.
a) Commitment to Online Security. Essential Mom intends to protect User personal information and to maintain its quality. To achieve information security and quality, Essential Mom implements appropriate measures and processes, such as using encryption when transmitting certain sensitive information. Essential Mom employs reasonable and current security methods to prevent unauthorized access, maintain data accuracy, and ensure correct use of information.
b) If you have an account on the Website, the account information and profile are password-protected. Essential Mom recommends that you do not divulge your password to anyone. Essential Mom personnel will never ask you for your password in an unsolicited phone call or in an unsolicited e-mail. Remember to sign out of your account and close your browser window when you have finished your session. This is to help ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place where others may have access to it.
c) As stated above, whenever you voluntarily disclose personal information online - for example on message boards, through e-mail or in chat areas - that information can be collected and used by others.
d) No data transmission over the Internet or any wireless network can be guaranteed to be perfectly secured. As a result, while Essential Mom tries to protect your personal information, it cannot ensure or guarantee the security of any information you transmit to the Website, and you do so at your own risk. Essential Mom shall not be liable for unauthorized disclosure of personal information due to no fault of Essential Mom including, but not limited to, errors in transmission and unauthorized acts of Essential Mom staff and/or third parties.
4. Essential Mom Use of Information.
a) Essential Mom uses your personally-identifying information to improve its marketing and promotional efforts, to statistically analyze Website usage, to improve Website content and product offerings and to customize Website content, layout, and services.
b) Essential Mom may use your information to deliver information to you that, in some cases, is targeted to your interests, such as targeted banners, new services and promotions. Essential Mom may ask you to provide it voluntarily with additional information regarding your personal or business interests, experience or requests, which Essential Mom may use to customize our service for you.
c) Essential Mom uses your e-mail address, your mailing address, and phone number to contact you regarding administrative notices, new product offerings and communications relevant to your use of the Website. Essential Mom will not send you promotions or announcements unless you give it permission to do so. d) If you place a request for products or services, Essential Mom uses information to ship your order; if the products or services are from a retail partner, we may provide your relevant information to that retailer for purposes of the transaction. If you establish a credit account with Essential Mom or its providers, Essential Mom collects additional information, including billing information, credit card number and expiration date, and tracking information from checks or money orders.
e) Essential Mom may also use or disclose information to resolve disputes, investigate problems, or enforce our User Agreement. At times, Essential Mom may review status or activity of multiple Users to do so. Essential Mom may disclose or access information whenever it believes in good faith that the law so requires or if Essential Mom otherwise considers it necessary to do so to maintain service and improve its products and services.
f) Essential Mom uses your IP address to help diagnose problems with the server, to manage the Website and to enhance the Website based on the usage pattern data received.
5. How You Can Update, Correct or Delete Your Information. If you wish to update, correct or delete your information on or from the Website, you must email EssentialMom.com at Gretchen@EssentialMom.com and request any such changes.
6. Children Under 13
a) Essential Mom has no way of distinguishing the age of individuals who access the Website, and so Essential Mom carries out the same Privacy Policy for individuals of all ages. If a child has provided Essential Mom with personally-identifying information without parental or guardian consent, the parent or guardian should contact us to remove the information and opt out of promotional opportunities. Essential Mom does not collect or maintain information from Users actually known to Essential Mom to be under the age of 13, and no part of EssentialMom.com is structured to attract anyone under the age of 13.
b) Information from Children. Essential Mom does not sell products or services for purchase by children, and will not knowingly collect or post information from a child under the age of 18 without the involvement of a parent or guardian. If Essential Mom learns that a User is under the age of 18, Essential Mom will notify the child’s parent or guardian at the e-mail address provided by the prospective User, alerting the parent or guardian to the child’s use of the Website and providing instructions as to how the parent or guardian can delete the child’s registration from the Website. Essential Mom does not knowingly use personally identifying information collected from children for marketing or promotional purposes, and does not disclose such information to any third party for any purpose whatsoever.
7. Your Consent. By using the Website, you, the User, consent to the collection and use of this information in the manner described herein and such use is hereby deemed acceptance of Essential Mom practices described in this policy statement. Any dispute over privacy between User and Essential Mom is subject to the provisions of this notice and to Essential Mom’s Terms of Use Agreement which is hereby incorporated herein and which can be read at EssentialMom.com.
8. Privacy Policy Changes. Essential Mom reserves the right to change or, update its privacy policy statement at any time and from time to time. A notice of any material change will be posted on EssentialMom.com for thirty (30) days prior to the implementation of such change. There are two boxes at the end of EssentialMom.com’s notice of change (1) an “I accept” box, and (2) an “I do not accept” box. If User does not mark the “I do not accept” box User will have accepted Essential Mom’s privacy policy updates.
9. Right to Cancel Receipt of Newsletter. User has the right at any time to cancel User’s receipt of the EssentialMom.com newsletter. This right of cancellation must be exercised by contacting EssentialMom.com by e-mail at Gretchen@EssentialMom.com.
10. Access Rights to Data
a) Information Maintained by Essential Mom. Upon User’s request, Essential Mom will provide a reasonable description of User’s personally identifiable information that Essential Mom maintains in its data bank. Essential Mom can be contacted by e-mail at Gretchen@EssentialMom.com.
b) Corrections and Changes to Personal Information. Help Essential Mom to keep customer personal information accurate. If User’s personal information changes, or if User notes an error upon review of customer information that Essential Mom has on file, please promptly e-mail Essential Mom at Gretchen@EssentialMom.com and provide the new or correct information.
